Privacy Policy Notice

Title V of the Gramm-Leach-Biley Act [GLBA] generally prohibits any financial institution, directly or through its affiliates, from sharing nonpublic personal information about you with a non-affiliated third party unless the institution provides you with a notice of its privacy policies and practices, such as the type of information that it collects about you and the categories of personal or entities to whom it may be disclosed.

In compliance with the GLBA, we are providing you with this document, which notifies you of the privacy policies and practices of Financial Partners, Inc.

The GLBA further requires that we inform you that you have a right to prevent us from sharing nonpublic personal information about you with a non-affiliated third party for any purpose that is not specifically authorized by law. Your right to prevent us from sharing nonpublic personal information about you with a non-affiliated third party for purpose that is specifically authorized by law is called your right “opt out” of such information sharing.

OUR PRIVACY POLICIES AND PRACTICES

1. Information we collect:

We collect nonpublic personal information about you from the following sources:

  • Information we receive from you on insurance applications or other insurance company forms with regard to insurance coverage in place.
  • Information about your transactions with us or with others as it pertains to insurance coverage in place.
  • Information we receive from a consumer reporting agency such as credit reports bearing on your credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics or mode of life which is used, expected to be used, or collected for the purpose of serving as a factor in establishing your eligibility for insurance to be used primarily for personal purposes.
  • Information we receive from claims adjusters or other individuals or entities concerning the processing or administration of claims that you might have as a result of purchasing an insurance product from us.
  • Information we receive from underwriting services such as CLUE or Fair Isaac provided for insurance companies and agents and used as a factor in establishing your eligibility for insurance to be used primarily for personal purposes.
  • Information we receive from government agencies such as motor vehicle records.
  • Information that we compile from sources that are within the public domain such as telephone books, city directories, and membership lists that are subsequently compiled into a nonpublic personal information database used by us.
  • Unless it’s specifically stated otherwise in an amended Privacy Policy Notice, no additional information will be collected about you.

2. Information we may disclose to third parties:

We may disclose all of the information we collect, as described above, about our customers or former customers, to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements. We also may disclose information about our customers or former customers as permitted by law.

3. Non-affiliated third parties to whom disclosures may be made:

We may disclose nonpublic personal information about you, such as we have described above, to the following types of third parties that perform marketing services on our behalf or with whom we have joint marketing agreements.

  • Financial institutions with whom we have joint marketing agreements such as insurance providers including those that have issued a policy or policies to you.
  • Financial institutions that may have loaned you money to acquire an item of personal property such as a house, boat, car, jewelry, etc. that requires proof of insurance coverage.
  • Other insurance agents or brokers to enable us to provide insurance coverage requested by you.
  • We may also disclose nonpublic personal information about you to non-affiliated third parties as permitted by law.

Notification of Your Right To Opt Out of Certain Disclosures

As we have indicated in this Privacy Policy Notice, we collect certain nonpublic personal information about you, and we may disclose that information to certain non-affiliated third parties for purposes other than those expressly permitted by the Gramm-Leach-Biley Act and the federal and state regulations implementing that Act. If you prefer that we not disclose nonpublic personal information about you to non-affiliated third parties, you may opt out of those disclosures, that is, you may direct us not to make those disclosures (other than those disclosures that are expressly permitted by the Gramm-Leach-Biley Act and its implementing regulations).

If you wish to opt out of such disclosures to non-affiliated third parties, you may check the appropriate box below on the attached form and return it to us as noted in the directions.

4. Our practices regarding information confidentiality and security:

We restrict access to nonpublic personal information about you to those employees who need to know that information in order to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

5. Our policy regarding dispute resolutions:

Any controversy or claim arising out of or relating to our privacy policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.

6. Reservation of the right to disclose information in unforeseen circumstances:

In connection with the potential sale or transfer of its interests Financial Partners, Inc. reserves the right to sell or transfer your information [including but not limited to your address, name, age, sex, zip code, state and country of residency and other information that you provide through other communications] to a third party entity that (1.) concentrates its business in a similar practice or service; (2.) agrees to be Financial Partners, Inc. successor in interest with regard to the maintenance and protection of the information collected; and (3.) agrees to the obligations of this privacy statement.

NOTICE OF PRIVACY POLICIES
YOUR PRIVACY IS OUR PRIORITY
At VSR, we are committed to maintaining the confidentiality of your personal information. We have adopted these Privacy Policies so that you will know what personal information about you we collect how we treat it, share it, and safeguard it. These Privacy Policies apply to all current and former customers of VSR.
INFORMATION WE COLLECT
In the normal course of business, we collect personal information about you from a variety of sources, including:

  • Information we receive from you on applications and other forms, such as your name, address, social security number, marital status, employment, assets and income;
  • Information we receive (either directly or via third-party service providers) from our clearing firm, mutual fund companies, insurance companies, and other product sponsors about your accounts and your transactions; and Information we receive from government agencies, consumer information reporting services, and other third parties we consult to verify your identity, employment, social security number, address, financial information, and credit information.

THE USA PATRIOT ACT AND YOUR PERSONAL INFORMATION
Federal law requires financial institutions to obtain, verify, and record information that identifies each person who opens an account. When you open an account, we are required to obtain your name, date of birth, address, and identification numbers. We may also have to review your driver’s license, passport, alien identification card, or other government-issued identification showing nationality, residence, and your photograph. If you don’t provide the information requested or your identity can’t be verified, we may not be able to open an account or carry out transactions for you.
INFORMATION WE SHARE WITH OTHERS
We share your personal information with our Representatives. We do not disclose your personal information to third parties, except to carry out your instructions, to create or maintain records used in our business, to service your account, to perform our responsibilities under joint marketing agreements with certain financial institutions (as explained below), or as required or permitted by law. For example, if you direct us to purchase shares from a mutual fund company, we will disclose your personal information to the mutual fund. We will also disclose your information if required to do so by law. Our customers’ information may be stored at locations controlled by third parties who provide computer and other services to us or our customers, subject to their agreement not to use the information for purposes unrelated to our business.  Some VSR Representatives are located in banks or other financial institutions with which we have joint marketing agreements. If your Representative is located in an institution with which we have a joint marketing agreement, we may disclose your personal information to the institution. Additionally, we will provide your name and address to companies we hire to assist us with distributing client statements, newsletters, legal notices, and other mailings. We will also provide your personal information to your new financial institution if you transfer your
account away from VSR. Please contact us using the information below if you do not want VSR to disclose your
personal information to your Representative’s new financial institution.
PROTECTING THE CONFIDENTIALITY AND SECURITY OF YOUR INFORMATION
We restrict access to your personal information to those employees, Representatives, and permitted third-parties who need to know that information to provide you or us with products or services, or to service your account. We maintain physical, electronic, and procedural safeguards that comply with federal standards to safeguard your personal information.
